The estate and its representatives
The estate is administered jointly by the dödsbodelägare – typically the surviving spouse or cohabitant, the statutory heirs and any universal beneficiaries under a will. As a main rule, they must act jointly, which can be difficult when heirs live in different countries. Powers of attorney are commonly used to allow one person to act on behalf of others.
A distinction is made between estate representatives (dödsbodelägare) and other beneficiaries, such as legatees who receive a specific asset or amount under a will.
The estate inventory (bouppteckning)
Unless an extension is granted, the estate inventory proceedings must take place within three months of the death. The inventory records the deceased's assets and liabilities at the date of death and lists the estate representatives. It is carried out at a meeting (förrättning) by two knowledgeable and trustworthy persons (förrättningspersoner). The estate representatives must be invited, and the surviving spouse or cohabitant must always be invited.
The inventory must be submitted to the Swedish Tax Agency (Skatteverket) for registration within one month after it has been drawn up. An application to extend the three-month period must be made within that period, and an extension requires grounds relating to the estate or another special reason.
The social welfare committee may issue a simplified estate notification (dödsboanmälan) where the statutory financial conditions are met: the assets, including the deceased's share of a surviving spouse's marital property, must cover no more than funeral costs and other expenses arising from the death, and must include neither real property nor a site leasehold (tomträtt).
Bouppteckning is not arvskifte
The estate inventory merely records the estate; it does not distribute it. Distribution takes place through the arvskifte, which is a separate document showing how the assets are divided between heirs and beneficiaries. An arvskifte must be in writing and signed by the estate representatives. Before distribution, the estate's debts must be paid.
Estate administrator (boutredningsman)
If the estate representatives cannot agree, or the administration is complex, any representative may apply to the district court for the appointment of an estate administrator (boutredningsman). The administrator then takes over the administration. Where the parties cannot agree on distribution, the court may also appoint an estate distributor (skiftesman).
International heirs and foreign assets
Heirs living abroad may need to provide certified documents, identity evidence and powers of attorney. Assets located outside Sweden may be subject to separate procedures in the country where they are situated, and banks and land registries abroad may require their own documentation, such as a European Certificate of Succession.
Frequently asked questions
Must I travel to Sweden to take part?
Not necessarily. Estate representatives may participate through a representative acting under a power of attorney.
What is the deadline for the estate inventory?
The estate inventory proceedings must normally take place within three months of death, and the inventory must be submitted to the Swedish Tax Agency within one month after it has been drawn up. Any application to extend the three-month period must be made before that period expires.
Are heirs personally liable for the deceased's debts?
As a general rule, no. Debts are paid from the estate. Heirs who distribute assets before debts are settled may, however, become liable to repay.
